1. USE OF SERVICE
Please read the terms thoroughly and carefully. By using and shopping on our Website, you agree to accept the terms and conditions described below. As the terms and conditions may be updated from time to time, we recommend that you check this page regularly to take notice of any changes we may have made in the terms and conditions.
2. OUR SERVICE
We sell outdoor clothing, which is specially designed to keep you warm, comfortable and dry when you get out there, whatever the weather. (“Our Service”).
We offer our services around the clock, unless our Website is not functioning for maintenance reasons, or for other reasons beyond our control.
This is a contract between you and us. You must read and agree to these terms before using the service. You may use the service only if you can form a binding contract with us and only in compliance with this Agreement and all applicable local, national laws, rules, and regulations.
You must be at least 18 years of age to be eligible to use the service. Any use or access to the service by anyone under 18 is in violation of this agreement.
4. ORDER PROCESS
You can place your Order at any time, in your convenience. You acknowledge that when you place an Order, you are making an Offer to us, which we can accept or deny in our discretion.
You must only make an offer through our Website. Any offer you place via phone, email, letters or fax, will not be accepted.
Do not place an Order if you are not sure of your choice(s). Review your choices before making an Offer. If you make an error, you may contact us and we will assist you.
Subject to our “Returns, Withdrawals and Complaints” policies, the Order you place becomes binding when you click “pay” and your receipt is displayed on your screen. Accordingly, the receipt is an acknowledgement that we have received your Order. That notwithstanding, we reserve the discretion to refuse your offer once when we send your receipt.
After accepting your offer, we will send you a shipping confirmation via email, to inform you that we have shipped your products.
We can only deliver your product to the list of countries in our Website.
Within 30 days of the delivery of your product, you have the right to inform us of your withdrawal of the purchase.
Our products meet the conformity requirements under the applicable laws of your country.
We deliver your products from Monday to Friday. The delivery times depend on your country of origin. An order that has been submitted on an Icelandic public holiday will be processed the next working day following the public holiday.
We reserve the right to decline your offer or cancel your purchase for any of the following reasons:
i. Your payment information is incorrect or not verifiable, or you are not approved in the Credit evaluation;
ii. Your order may have been placed for fraudulent purposes, or in connection with a criminal offence or other unlawful activity;
iii. There was an unintentional error on the Website; e.g. a payment error etc.;
iv. We have reason to believe you are a minor under the age of 18;
v. We could not deliver to the address provided by you
All prices are inclusive of value added tax (VAT).
Your price may also include other charges such as charges for delivery and other services. Accordingly, before you place your Order, we will inform you of all items in your total price.
We reserve the right to change the prices in our discretion.
We ship duty free to all countries.
We accept payment for your Order strictly through the following payment methods: VISA, MasterCard, Amex, and PayPal.
In the event you make your payment via Credit Card, your account will be deducted after we have verified your Order and the ordered products have left our stock.
In the event you use Paypal or a debit card, we will deduct the payment from your account when we confirm your order.
We shall make the payments to the billing address you provide to us, or as it appears in your bank statement.
The prices for the clothes are displayed according to the currency of the country you select.
You acknowledge that the price of your order is determined by your country of delivery.
7. PRODUCT INSPECTION
Once the delivery of the products is completed, you bear sole risk of the products.
Without prejudice to your statutory rights and remedies you have the responsibility of inspecting your products for any faults and, in the event, giving us notice of any complaints.
You have the right to decline receipt of the products if the package is damaged upon its delivery to you, or if you receive non-conforming products.
You also have the right to keep the defective product and ask for a reduction of the price. In that case please contact our customer service.
8. RETURNS & WITHDRAWALS
You have 30 days to cancel your purchase and return delivered products or exchange your purchased products. To be eligible for a return, your item must be in the same condition and same original packaging that was delivered to you. You need to register the return online before you send the product back to us. Please visit our return page for more information.
We will bear full responsibility of errors that are due to us.
If you notice any defect on your purchase or any other issue with your order within 30 days from receiving your purchase, please register your return online and send it back to us. For more information see our return page.
In the event you provide a wrong address for delivery of your purchase, the shipment shall be returned to us. Accordingly, you shall take care of any expense incurred in reshipment of your purchase when you afterward provide a valid address.
After we receive and process your request you will be issued with the appropriate refund. We aim to process a refund within 3 business days of receiving your parcel, or of receiving evidence of you having sent back the parcel, and send you an e-mail to let you know we have received and processed it. After you have received the e-mail, please allow another 5-10 business days for the refund to be credited to your account. The amount of time this takes will depend on which bank or card issuer you have. Unfortunately, this delay is outside of our control. You can expect a refund in the same form of payment originally used for purchase. In the event that we are unable to refund your credit card we will contact you to arrange an alternative means of refunding your order.
10. OUR PROPRIETARY RIGHTS
ZO•ON alone shall own all rights, title and interest, including all related Intellectual Property Rights, in and to our Service.
Our Agreement is not a sale and does not convey to you any rights of ownership in or related to our services, or the Intellectual Property Rights owned by us. Accordingly, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any of our content. Use of our content for any purpose not expressly permitted by this agreement is strictly prohibited.
The service, our name and logo are the exclusive property of ZO•ON.
We shall own all rights, title, and interest to any content, suggestions, ideas, enhancement requests, feedback, recommendations, or other information provided by you or any other party relating to our services. Accordingly, you may choose to, or we may invite you to submit comments or ideas about our services, including without limitation about how to improve our services or our ideas. By submitting any idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place us under any fiduciary or other obligation, and that we are free to use the idea without any additional compensation to you, and/or to disclose the idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, we do not waive any rights to use similar or related ideas previously known to us or developed by our employees or obtained from sources other than you.
We care about the privacy of our Customers. You understand that by using the service you consent to the collection, use and disclosure of your personally identifiable information and will only be used to identify what the customer needs are to the service providers and in full compliance with GDRN regulations.
In order to protect your information, ZO•ON uses one of the most secure online ordering systems on the market, and we’re constantly researching and improving our software to make sure we offer the highest possible security at all times.
We care about the integrity and security of your personal information. We cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.
Further, in order to protect our Consumers and maintain the security of shopping online, we may run verification checks on the data you submit when you place an offer. These checks may include address and payment verification and screening of your offer to prevent fraud.
13. THIRD RECOMMENDATIONS AND INFORMATION
Our services may contain recommendations and information to third-party that are not owned or controlled by us. We do not endorse or assume any responsibility for any such third-party information, materials, products, or services.
When you contact a third-party service, and/or engage a third-party from the service, you do so at your own risk, and you understand that this agreement does not apply to your use of such third-party sites, services, or products. You expressly relieve us from any and all liability arising from your use of any third-party website, service, product or content.
14. INDEMNIFICATION AND RELEASE
You agree to release, defend, indemnify, and hold us, our associates, and our respective officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your violation of these Terms.
15. NO WARRANTY
Use of the service is at your own risk. to the maximum extent permitted by applicable law, the service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, or non-infringement. no advice or information, whether oral or written, obtained by you from us or through the service will create any warranty not expressly stated herein. Without limiting the foregoing, we do not warrant that the content is accurate, reliable or correct; that the service will meet your requirements; that the service will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; that any requests will be met satisfactorily or at all.
We do not guarantee the suitability, safety, or ability of any third-party provider, nor that any such third-party provider will meet your requirements or expectations. We do not warrant, endorse, guarantee, or assume responsibility for any service advertised or offered by a third party through our service or any hyperlinked website or service, and we will not be a party to or in any way monitor any transaction between you and providers of such third-party services.
Some jurisdictions do not allow the exclusion and limitations of certain implied warranties, so the above exclusions may not apply to you. This agreement gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction.
Without limiting the foregoing, your correspondence or business dealings with, and use of services of third parties or service providers provided by us, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third party. You agree that we shall not be responsible or liable, directly, or indirectly, for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third parties or Service Providers.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall we and our employees, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this service.
To the maximum extent permitted by applicable law, we assume no liability or responsibility for any personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service.
The language used in the contract is English.
18. ENTIRE AGREEMENT
We store all contracts made, including your offer and the order confirmation, and we recommend that you file these too, as subsequently the documents will not be accessible. However, please see “Track your order and view history” section of our Website.
If any portion of these terms is found to be void or unenforceable, it shall be struck from the record, and the remaining provisions will retain their full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
21. GOVERNING LAW
You agree and consent to the exclusive jurisdiction of the state or federal courts located in Iceland, and waive any defense of lack of personal jurisdiction or improper venue or forum to a claim brought in such court, we will elect, in our sole discretion, to litigate the action in the county and state where we are located.
